Role of Contracts in Procurement and Supply

Date : Wed,May 17, 2017  |  Time : 15:30  |  Location : ANBARA - L5

Facilitators: Olga Labai, Diya Nasereddin, CIPS

Efficient Procurement and Supply always means effective and smart contracting. In industries, vital for the regional growth, such as construction, petrochemical, logistics, transportation and pharmaceuticals, contracts tend to be very complex and they establish numerous concurrent obligations of the parties. It is a strong regional trend that whereas commercial portions of such contracts are often well very looked after, so called “legal” part of a contract (i.e. terms and conditions) tends to be seen as a major impediment to doing business. As a result, in ways often self-harming, companies apply standard contract templates across the board, decline any requests for negotiations and otherwise limit their contract practices with the idea to save time and cost.

Workshop is devoted to explore how overall improvement of contract practice can be achieved through better understanding major risks and factors related to commercial contracts. Participants will gain clarity on how smarter contracting positively effects outcomes of procurement and supply. Participants will generate ideas on how to increase general legal awareness and core contract competences such as understanding general terms and conditions, claims management, effective communication with suppliers in the Region.

Workshop’s Critical Question: “What actions can this region take to ensure efficient work with contracts?”.

SUGGESTION: The Chatham House Rule will be invoked at the meeting to encourage openness and the sharing of information: When a meeting, or part thereof, is held under the Chatham House Rule, participants are free to use the information received, but neither the identity nor the affiliation of the speaker(s), nor that of any other participant, may be revealed.

OPEN MIC: Following the introduction to the topic, Workshop structure will follow an Open Floor format whereby all participants will be encouraged to engage in the free flowing conversation and not wait to be called upon to speak.

COME PREPARED WITH RECOMMENDATIONS: All Participants will be encouraged to come to the table with recommended strategies in answer to the Workshop’s Critical Question.

WORKSHOP OBJECTIVES:
Shortlisting 5 recommendations

The 90 min Workshop will be broken into 3 parts:
  • Commentary from Facilitators
  • Open Mic with Recommendations Put Forward
  • Voting on Recorded Recommendations with final shortlist of 5

Network security and breaches have increased exponentially in the last five years, with attackers exploiting every vulnerability they could find in hardware or software of the device. International Regulation – An Overview of Basel III

Date : Thu,May 18, 2017  |  Time : 12:30  |  Location : ROTANA - L5

Alastair Tyler, FCIB International Director and Faculty, The London Institute of Banking & Finance (LIBF)

Following the recent Global Financial Crisis and series of conduct scandals, regulators around the world have brought in a range of new rules and measures to ensure that systemically important financial institutions can weather any future financial and economic stresses.

The Basel Committee on banking supervision introduced ‘Basel III’ capital and liquidity standards, which are being progressively phased in and the European Union brought in Capital Requirements Directive IV (CRD IV). CRD IV is intended to implement the Basel III agreement in the EU. This includes enhanced requirements for:

  • the quality and quantity of capital;
  • a basis for new liquidity and leverage requirements;
  • new rules for counterparty risk; and
  • new macroprudential standards including a countercyclical capital buffer and capital buffers for systemically important institutions

This short interactive workshop from The London Institute of Banking & Finance (LIBF) provides a robust review of recent developments in international regulation for banks. In this taster session we look at what constitutes bank capital – its key characteristics and the importance of maintaining sufficient capital. We also explore the risk return trade off; looking at factors which might contribute to a deterioration of a bank’s capital position and potential management actions that can improve it.

The session then explores what Basel III is and how it is adopted into legislation across the world. The workshop goes much further, to discuss the likely effects of all these changes on the international banking business models, and how it impacts bank customers.

The session concludes with a summary of LIBF’s credentials and an over view of our professional certification programme.

Muhammad Jawad Ali, Manager Operations, RICI

Resource Inspections Canada Incorporated (RICI) is a Management System Certification Body accredited as per ISO 17021 by IAS (USA) and Training Organization approved by CQI-IRCA (UK) and PMI (USA).

RICI is the only certification body providing personnel certifications for different metrology fields and civil technicians catering this oil & gas and construction industry. In this workshop, RICI will introduce all of its training and certification programmes and their direct influence on this industry. Specific focus will be given to the personnel certification in metrology fields i.e. science of measurements.

Qualitative and Quantitative data analysis require measurement using multiple instruments. Results of measurements depends upon accurate and precise measuring instruments; however, the true values of measured variables are seldom known, on the other hand measuring have inherent errors, e.g., due to people, instruments, measurement methods, reference material, facility and environmental effects. The major source of systematic errors and uncertainties is undoubtedly measuring instruments. To minimize the errors and to have confident results, instruments are required to be reliable, accurate and precise for which a calibration methodology is required.

Methodology for calibration entails qualified & certified technicians, traceable equipment and standards or validated methods. Metrologists or Technicians performing the calibration should be technically qualified, trained and should have good statistical skills which can be analysed by different personnel certification programs as per ISO 17024 and the general standard that can be applied to any organization involved in metrology is ISO 17025 for the general competence of calibration and testing requirements.

“The King should examine the weights and balances every six months to ensure true measurements and mark these with Royal stamp.”
Quoted in Manusmriti, 8th chapter, sloka 403 (Around 1600 yrs old).

Discussion points of the workshop include:
  • Participants will learn about the basic concepts of Measurements, Metrology and Testing and their critical need in today’s world.
